ARTICLE 3 – SCOPE OF APPLICATION
These General Terms and Conditions apply to all offers from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the contract is concluded, the full text of these conditions will be made available to the consumer. If this is not possible, it will be explained how the conditions can be viewed or how they can be sent to the consumer free of charge.
In the case of electronically concluded contracts, the text can also be provided in digital form so that the consumer can store it on a durable medium.
If additional conditions apply to specific products or services, the consumer is entitled to the more favorable provision in the event of conflicting clauses.
ARTICLE 4 – THE OFFER
If an offer is limited in time or subject to specific conditions, this will be clearly stated in the offer.
All offers are non-binding. The entrepreneur reserves the right to change content or prices at any time.
The offer includes a complete and accurate description of the products and/or services offered. Images are for illustrative purposes only and may vary. Obvious errors in the offer are not binding on the entrepreneur.
Every offer contains clear information about the consumer's rights and obligations upon acceptance, including:
- possible additional costs such as customs or import duties;
- any shipping costs;
- the order process;
- the existence or exclusion of a right of withdrawal;
- payment and delivery terms;
- validity period of the offer or price.
ARTICLE 5 – CONCLUSION OF THE CONTRACT
A contract is concluded as soon as the consumer accepts the offer and fulfills the conditions set out therein.
Upon electronic acceptance of the offer, the entrepreneur will immediately confirm receipt of the order electronically. Until confirmation, the consumer may revoke the contract.
The entrepreneur takes appropriate technical and organizational measures to secure data transmission during electronic contract conclusion. Recognized security standards apply to online payments.
The conclusion of the contract is subject to the availability of the ordered products.
ARTICLE 6 – RIGHT OF WITHDRAWAL
When purchasing products, the consumer has a right of withdrawal of 30 days, starting on the day after receipt of the goods by themselves or a designated person.
During this period, the product should only be inspected to the extent necessary to assess its nature and function. If the right of withdrawal is exercised, the consumer must return the product with all accessories, preferably in its original condition and packaging, according to the return instructions provided.
The withdrawal must be declared in writing or by email within 30 days. The product must then be returned within another 30 days. The consumer is responsible for providing timely proof of shipment.
ARTICLE 7 – COSTS IN CASE OF WITHDRAWAL
If the consumer exercises their right of withdrawal, they bear the direct costs of returning the products.
If the consumer has already made payments, the refund will be issued no later than 14 days after receipt of the return or presentation of proof of shipment.
ARTICLE 8 – EXCLUSION OF THE RIGHT OF WITHDRAWAL
An exclusion of the right of withdrawal is only permissible under certain conditions and must be clearly communicated to the consumer in the offer or at the latest before the contract is concluded.
The following products may be excluded from withdrawal:
- Goods made to customer specifications;
- Goods with a personalized character;
- Goods whose seal has been removed for hygiene reasons and are therefore not suitable for return.
ARTICLE 9 – PRICES
During the validity period stated in the offer, the prices of the products and/or services offered remain stable, unless legal changes require an adjustment.
Subsequent price changes do not entitle the consumer to a refund. By completing the order, the consumer accepts the price valid at that time.
